Terms and Conditions

§ 1 Scope
1.1 These general terms and conditions apply exclusively between HD Solutions GmbH and customers for E-Visa applications in the version valid at the time of contract conclusion.
1.2 Terms and conditions of the customer which are contrary to or deviate from these general terms and conditions are not recognised unless we have explicitly agreed to their validity in writing.
§ 2 Service provisions
2.1 Contract formation
2.1.1 Online offers are non-binding. The contract offer becomes binding upon submission of the E-Visa application form via online-visa.com.
2.1.2 Orders are placed by clicking "Apply now" after data entry. Entries may be corrected or the entire process cancelled before final submission.
2.1.3 After submitting the form, you will receive an automatic confirmation email acknowledging receipt of your order. This does not constitute acceptance of the application.
2.1.4 The contract is concluded upon written order confirmation or processing of the application.
2.1.5 The contract text is saved by the company for online transactions.
2.2 Cancellation rights
2.2.1 Customers may withdraw within two weeks without providing reasons in text form (letter/email). The period begins after receipt of this information in text form.

2.2.2 Upon effective withdrawal, both parties must return received services. Refunds must occur within 30 days.
2.2.3 The right to withdraw expires prematurely if service execution begins before the withdrawal period ends with the customer's express consent.
2.3 Service scope
2.3.1 The company facilitates E-Visa applications under the conditions established by each country. We are not liable for granting the customer a travel authorisation; immigration authorities make the final decisions.
2.3.2 Customer data is forwarded promptly in the required formats to the competent authorities.
2.3.3 E-Visa applications require timely receipt of all data required by the authorities.
2.3.4 If fulfilment becomes impossible due to force majeure or unforeseeable events, both parties may withdraw. Upon withdrawal, the customer owes a processing fee of €20.00 for costs incurred.
2.4 Customer obligations
2.4.1 Customers must provide all required information and materials (photos) in a timely manner and in the required form and quality.
2.4.2 Customers must ensure the accuracy of the data provided and report any changes immediately. Multiple registrations under different names or addresses are prohibited.
2.4.3 Customers transfer all usage rights to submitted photos and confirm that no third-party rights exist.
2.4.4 Contract violations entitle the company to withdraw and/or claim damages.
2.5 Pricing
2.5.1 Prices are binding, gross, and include VAT, incidental costs, shipping within Germany, official government fees, and all E-Visa application costs including related consultation.
2.5.2 Not included: comprehensive visa services for embassies and third-party costs potentially incurred during applications.
2.6 Payment
2.6.1 Service fees are due without deduction upon form submission.
2.6.2 Customers select the payment methods offered during checkout.
2.6.3 Payment default occurs if fees are not received within ten days. Default interest: 5% above the base rate for consumers, 8% for businesses.
2.6.7 Full refunds are issued automatically if authorities reject applications, unless the customer caused the rejection through inaccurate information.
2.7 Liability limitations
2.7.1 The company assumes unlimited liability for fraudulent concealment, quality guarantees, product liability, personal injury, and intentional or grossly negligent damage.
2.7.2 Other damages are covered only for essential contract violations, limited to foreseeable typical damages, capped at twice the paid purchase price.
2.7.3 The company is not liable for damages outside the service itself, in particular lost profits or financial harm to the customer.
2.7.6 Government actions remain outside the company's control; no liability is assumed for authority actions or omissions, legal changes, or programme terminations.
2.8 Data protection
The company protects privacy and handles personal data confidentially. Data is processed primarily for contract fulfilment and forwarded to appointed third parties. Detailed information on data handling is available in our Privacy Policy.
§ 3 Final provisions

3.2.1 German law governs all legal relationships, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
3.2.2 Berlin is the exclusive place of jurisdiction for disputes where the customer is a merchant, legal entity under public law, or special fund under public law.
3.3.3 The contract language is German.
§ 4 Dispute resolution
The company does not participate in consumer dispute resolution proceedings. The competent body is:
